Bizzare Beach Boys album find

I was just at the flea market and I saw a very strange Beach Boys album, it was NOT Capitol, and it was a "Best Of" compilation and it features the Hite Morgon recordings on it. Luau etc, but it also had some songs that I had never heard of before, one song was called "Undertow" and about 5 or 6 more songs that I'm guessing aren't really the beach boys, the record says it's them though, of course I didn't buy it because I didn't know what it was but also I didn't have the money..

Just one of hundreds of the knock-off releases with the Morgan cuts that have been sold over the years; packaged with songs by anyone they could pass of as close to the BBs ( and cheap)

Tioga - Frogmen (Candix 326, 1961)
Beware Below - Frogmen (Candix 326, 1961)
Underwater - Frogmen (Candix 314, 1961)
Phantom Surfer - Tornadoes (Auertaun 45-103, 1963)
Bustin' Surfboards - Tornadoes (Auertaun 45-100, 1963)
LDC - Surfin' Six
409 - Surfin' Six

Thanks for answering a question I was too lazy to ever try to find the answer to.

I paid $5 bucks for still sealed one (of these knock-offs, maybe not this exact one) - I bought it more for the Frogmen track to hear its alledged influence on the Do It Again dit-a-dits

My cheapo comp bought at the local tobacconists' and dated 1987 does indeed include the three above tracks.
It kicks off in fine style with "Surfin'", "Barbie", "Karate", "Luah, Luah" [sic] and "Surfer Girl", all apparently mob-handed BB compositions (Beach Boys). "Surfin' Safari" gets the correct writing credits, as does "What Is A Young Girl Made Of?". Quite honestly, I cant be @rsed to check whether they're all the real thing. The final touch is the cover shot of the band onstage featuring a besequined Mike. i suppose this gunk is still a cut above the faux compilations you can buy on cross-channel ferries...

How is it these cheapo labels get away with this yet Brad Elliott got sued for it?

I for one would be interested to know why Elliott has such a bad name these days.

are the Hite Morgon songs Public Domain? or does someone keep on leasing them out to these small labels and if so why not give them to Capitol (or sell if need be) ?

I've had it whispered to me that certain parties used the potential release of
First Wave
as something of a Trojan Horse with which to settle a few scores with Elliott. Certainly it's a more plausible theory than suddenly deciding after some thirty plus years of mostly very shoddy releases of those tracks that they actually belonged to the band (they don't, and never have), and it must be admitted that it was entirely successful. In this respect, I'm on Elliott's side: he was definitely the injured party. In most other plaints people have laid against him, he was the sole architect of his own downfall.

Wasnt the Lost&Found album the first "official" release of the Hite Morgan pre-Capitol demos?

Surfin'
is a redaction of
Lost & Found
, with a few addition BB-related tracks (e.g the Tri-Five single), as is the third title. Check 'em out on Spotify.
