Just bought the amazing 1967 - Sunshine Tomorrow. If you haven't done so already, go out and buy it; you need it if you're reading this.  Listening to it led me to pull out my mono copy of Smiley SMiLE to compare to the re-channeled pseudo-stero copy posted above.   Usually, fake stereo versions suck. This Smiley SMiLE is the exception. It sounds pretty good to me - it's brighter than the slightly dark sounding mono version. My earlier excitement was mostly in reaction to the pristine state of the vinyl. It's rare to find a (likely un-played) copy of a 1967 record by a major band in 2017. It's like entering a time capsule and experiencing another by-gone era for a brief moment. The original mono version does have its own pleasures and cachet. Hard to pick a favorite; mono probably gets the edge.  Further July 4th listening material:

I remember that episode of What's Happening!! Don't mess with Asia, either. I saw something similar go down at a concert by the band Asia ca 1992 at Toad's Place in New Haven. (BTW, I'm not a fan of Asia, but the ticket was free & Steve Howe was in the band.) Some guy brought in a tape recorder slung over his shoulder, like a purse. He had a big microphone, similar to the kind you would see a TV news reporter use on a location shot. He was standing in the middle of the crowd. It was open and obvious. After a few songs, two bouncers saw him too and escorted him out of Toad's. So, there was definitely a risk involved with taping back in the day. Clinton Heylin goes into this somewhat in his book "Bootleg." More tales from the early days of bootleg records can be found at Ken Douglas' old blog. He talks more about producing the actual records, than how they were recorded, as far as I can recall. I'm rather partial to If Only I Could Remember My Name.
I'm rather more than partial - truly amazing piece of work, and one of the very few that manages to be both resoultey of its time and timeless. In my album Top 10, no question. A dream of an album. For my money, the best album that came out of the late '60s early '70s SF scene.

Mike Love's lawsuit against Brian Wilson & other defendants re the free CD give away in a UK newspaper ends in a loss to Mike in the 9th Circuit Court of Appeals. Read the decision here: http://www.ca9.uscourts.gov/datastore/opinions/2010/07/08/07-56008.pdfMike Love lost in the district court and now the Court of Appeals affirmed the lower court's decision. The ruling was on purely procedural grounds, so if you're not a lawyer, most of the decision will be hard to decipher. The basic gist of the decision was that Mike could not sue in a US court because nearly all of the things he complained of (e.g. the free CD give away) occurred in the UK, not the US. The decision shows that Mike had a very weak lawsuit on nearly every front. The Court of Appeals noted that the district court judge "strongly admonished" Love for first claiming his legal residence was in Nevada and then later alleging his legal residence was in California merely because he happened to own a home in California. (p. 6) The lower court judge also bashed Mike's attorney for trying to use a "sham" affidavit that contained "fabricated" evidence. (p. 6 & p. 16, footnote 7) Finally, Mike had to pay the attorney's fees of several of the Defendants. (p. 17) In the US, the general rule is that each side has to pay its own attorney's fees, unless there a contract provision proving for such fees or such fees are authorized by statute. The Court of Appeals found that there were both contractual and statutory provisions that allowed some of the Defendants to force Mike to pay those Defendants' attorney's fees. So, not only did Mike lose his lawsuit, he also has to pay his opponents' attorney's fees on top of paying his own attorneys. Mike could try to appeal to the US Supreme Court. However, because the Supreme Court is highly selective about the cases it hears, even if he tried to get the court to hear his case he will very likely be denied. So, this is probably the end of the story for this case.

As we all know, the LV Sun is THE source for official BB information. Until there's an official press release/press conference, I'm not buying it. I find it hard to believe that an "official" BB event like this would first be announced in an otherwise uneventful interview w/ the Las Vegas Sun. I think Mike's announcement was more like a trial balloon (or Mike's wishful thinking) to get the wags talking and drum up some interest. It appears this non-announcement announcement has done the trick. W/ something this big there would be a carefully orchestrated announcement and press release, press conference, photo op, etc. like the 40th anniversary celebration of Pet Sounds on top of the Capital building. While I'm not saying that it definitely won't happen, I'm just not convinced by the facts that we have so far.
