So I opened up my local newspaper (Knoxville, TN) today to find an add for an upcoming Beach Boys (Mike and Bruce) show on the 22nd of this month at Dick Clark's American Bandstand Theater.  I thought it was an odd choice of pictures to use for the modern day band.  They used this one:

Are they allowed to use that to promote Mike and Bruce's show?  Not trying to stir anything up, I'm just curious as I don't know for sure.  It seems kind of deceitful to have Brian, Carl, and Al front and center in the ad when they won't be there.  Obviously those of us that are "in the know" know better, but the casual "greatest hits" fan may not have a clue.  Is this not the same kinda thing Mike has sued Brian for in the past?

This is more than likely the fault of the newspaper than it is the band.  They probably just found a random picture of the group and threw it in.  I believe Mike & Bruce have their own promotional picture they use for their shows. 

In my experience (both working on papers and placing ads in them), they don't just locate and place pictures. The buyer normally has placed it--or at least approved it if someone from the paper helps. So I'd think someone working press for the Beach Boys either placed or approved it.

That said, if anybody's filing any lawsuits, it ought to be about placing a pic from such a horrendous time for fashion. Those jackets, the hair, the collars and Al's aforementioned shoes--VELCRO? (Carl's shoes are no slouch in the ugly department, either.)

I'm no lawyer, but they may have gone over the line here-using pictures that do not accurately portray the actual group that is appearing seems corrupt-especially Carl. I would assume that permission from Carl's estate would have to be obtained and that Al would have to approve his being portrayed as part of  the  Mike and Bruce Tribute  Band. The who;e thing is fradulent and I would fault Al or Carl's estate from going after Mike's ass in court-Mike would surely litigate if Al or Brian used his homely image in their  promotions-

Wow, I've seen that picture so many times, but it's just a horrible horrible picture. Is that from the 1985? It would make alot of sense if it was.

It is from 1985 if I'm not mistaken.  When I saw the add I wondered why in the hell they would ust that pic!  Even if they were going to use a pic with Brian, Carl, and Al and be misleading, why not use a pic from the classic years?  This picture is horrible!!!

Similar picture used in the LA times a year or two back. Go to the show and enjoy the concert.


Then do the promoter for false advertising. ;)

Wow, if I went to the show could I sue them?? I certainly wouldn't be seeing the group shown in the photo. Maybe I could get some of Mr Loves money!!

( just kidding of course. I do know who is in the present line up and wouldn't see them if the ticket was free and I was picked up in a limo driven by Mike)

I wouldn't mind going, but I already have a ticket to go see the Black Crowes on the exact same date.  Plus, the tickets are pricy!  Nosebleeds are $20 which isn't so bad, but if you actually want to SEE the band, you are paying $60!!!  No thanks.  Not for Mike and Bruce at least.  I only paid $50 to see Brian!

Although, it would be worth it if I can sue for the false pic!   :lol
