Court date set for $2 million lawsuit between former Beach Boys

A Feb. 11 date was set today for a non-jury trial in Beach Boys frontman Mike Love's $2 million lawsuit against former bandmate Al Jardine, and the judge said he does not want to see any further delays.
"This case needs to be decided and a decision needs to be made, and that's what I intend to do," Los Angeles Superior Court Judge James R. Dunn told lawyers for Love and Jardine during a trial-setting conference.
Dunn also set a pretrial hearing for Nov. 28 to hear any final motions in the case.
Love and Brother Records Inc., the Beach Boys' corporate identity, sued Jardine in April 2003 for allegedly fronting a group that used various versions of the Beach Boys name.
In his court papers, Love's lawyer, Phillip Stillman, calls the bands Jardine toured under as "Beach Boys knockoff bands." He is asking for $2 million in attorneys' fees on behalf of Love that were spent on a federal court case in which Jardine was found to have infringed the Beach Boys trademark.
Jardine's lawyer, Lawrence C. Noble, maintains the motion for attorneys' fees should have been made in federal court and that the current request should be barred. Stillman claims Noble's argument is not supported by the law.
Jardine played football at Hawthorne High School with another former Beach Boys member, Brian Wilson, and also sang the lead on one of the group's most famous songs, "Help Me Rhonda."

Some say the current touring BB's are as much a knockoff band as Alan's band..(sorry about this, Bruce)....you can do the music justice, but without Alan, Carl, Dennis and Brian, as well as some more veteran band members, like maybe Ed Carter, Bobby Figeuroa, Richie Cannata and Billy Hinsche you don't have the BB's that the "trademark", that you fought for and won, represents.
Mike, you have the rep for being the mean one of the group, it's these multiple lawsuits that are giving you this label. I know, it's only business in the music industry world.

What a surprise, Mike's on the warpath again. Such a tool. I'm sure he's
still wondering why everybody's always down on him, too. I'd estimate
I'm not alone in hoping he gets another legal slapdown.

It appears that Mike isn't interested in what kind of legacy he leaves behind-he seems to work very hard to destroy any fondness that anyone would have maybe had for him at one time-Obvoulsly money has become his reason for life itself-he cannot seem to break out of this litigeous modeand he of all people is the stateside salesman for TM-can anything be more hypocritical?? Eventually people are going to dismiss him entirely as an old, pathetic, attention-craving fool-how can anyone in their right mind seriously think of this guy as anything but a greedy has-been?

Perhaps the only thing that could straighten this out is if Al, Bruce and Dave all joined Brian Wilson full time. That might be the only way to straighten Mike out. I don't think that this would be a problem for Brian personally, but his attourney's and Melinda probably wouldn't want that.

Al did work with Brian for a little while....but Al said that those around Brian and he had some problems, according to someone at the blueboard a week or so ago, I guess he had either talked with Al or overheard something, or maybe he was making it up for shock value, who knows.

Not another suit so much as asking to have the costs reimbursed. Is that not the case?
I wonder if the California Bar Association will raise a memorial to the Beach Boys?

They should, they probably hold the record for the most lawsuits by a music group. Dedicate a room in their name somewhere in the superior court building or something.

That does seem routine, to ask for court costs. I'm not sure which guy is less in a position to lose $2 million. On the face of it, I'd say Al, but maybe not. Probably neither.

I don't think the remaining members joining Brian would do squat for Mike. He'll continue to tour as the Beach Boys; Bruce or no Bruce.

(AP) Los Angeles- In a a shocking reversal of legal fortunes today, Judge James R. Dunn awarded a trademark on the name "Mike Love" to defendant Al Jardine, sued by Love for misappropriation of the Beach Boys name, and gave the Beach Boys lead singer thirty days to submit a new name to the court, which Jardine must approve. The plaintiff has already rejected Jardine's suggestion of "Chicken George" as a suitable new moniker. The singer formerly known as Mike Love was also sentenced to three years of law school during which time his attorney, Phillip Stillman, will fill in as front man for the popular sixties vocal surf band at over two thousand shows currently scheduled for that period.
Jardine has already announced plans to lease the trademark "Mike Love" to an all-midget harmonica band currently touring the American midwest, who will perform as "The Mike Love Family And Friends". Several of the midgets claim actual paternity by Love. The singer formerly known as Love has filed a counter-claim against Jardine, Judge Dunn, Stillman, and the midgets, but will report to class at the Irving Kanarek School Of Law this Fall.
Judge Dunn also reprimanded Beach Boy Bruce Johnston for attending the hearing in short pants, and censured attorneys for both the plaintiff and the defendant for gratuitous bald jokes.
Last year the singer formerly known as Love successfully defended suits involving his former name by the estate of musician Arthur Lee as well as the promoters of a Las Vegas Beatles-themed show, and unsuccessfully sued the band Led Zeppelin for uncredited contributions to their song "Whole Lotta Love", which he purports was written about him, and to which he claims to have contributed the lyric "You need coolin', and that's no foolin'", and to have suggested several of the grunts and groans near the end of the song during a long-distance phone call in 1969.
The forthcoming career-retrospective box set "Every Inch Of Mike Love" has been placed under injunction pending legal actions by Led Zeppelin and Jardine.

It sems to me that this unending business of Beachboy related lawsuits is a blackeye for all, including Brian, Al, Dave Marks and others.
Maybe they should get together and force Mike to relinquish use of the name.

That probably won't happen because Brian & Al still have money coming in from Mike's shows, as a portion of profits goes to BRI, of which Brian & Al are still a part.
